Once you have signed and filed your divorce documents you will receive a court date from the Superior Court. The Judge then will stamp and seal your divorce and finalize it.

Residency Requirements

To file for a divorce in New Jersey State, either you and or your spouse must have been a resident of the State for at least one year before filing the action.

Grounds for Filing a Divorce

New Jersey State requires a Complaint for Divorce that declares an appropriate ground of reasons why the action for divorce is taking place. You must select one applicable reason that applies to your situation.

Any of the following grounds may be used for divorce in New Jersey.

Irreconcilable Differences:

Irreconcilable Differences which have caused the breakdown of the marriage for a period of six months and which make it appear that the marriage should be dissolved and that there is no reasonable prospect of reconciliation. Based on this divorce ground, no separation time is required to file for divorce.

No-Fault/Separation of 18 Months:

You and your spouse have been living separately for a period of 18 months or more without any reasonable prospect of reconciliation.

Desertion/Abandonment:

Your spouse has left and been gone for a period of 12 months. He/She has deserted you. Spouse refused to allow you into your residence for a period of 12 months.

Extreme Cruelty:

Physical and or Mental abuse that makes it improper, impossible or unreasonable to expect the individual to cohabitate with their spouse.

Addiction:

Addiction involves a dependence on a narcotic or other controlled, dangerous substance or habitual drunkenness for a period of twelve or more consecutive months immediately preceding the filing of the complaint.

Institutionalization:

When one spouse has been institutionalized for mental illness for a period of twelve or more consecutive months after the marriage and preceding the filing of the complaint.

Imprisonment:

Imprisonment as a ground for divorce occurs when a spouse has been imprisoned for eighteen or more months after the marriage.
